These terms govern the relationship between Key West Appliance Repair and its customers, outlining rights, responsibilities, and limitations for both parties. Together with our policies, including our Privacy Policy and any signed agreements or service contracts, these Terms of Service constitute the entire agreement.

We strongly encourage you to read these terms thoroughly before engaging in our services. By allowing our appliance repair technicians to commence work or by scheduling an appointment, you acknowledge and agree to these terms. Non-Refundable Service Charge

Key West Appliance Repair requires a non-refundable service fee for each service call. This fee covers the cost of the initial inspection, diagnostic services, and travel to your location. The service charges are payable regardless of whether the customer decides to proceed with the recommended repair.

The non-refundable service fee will be applied toward the total cost of repairs if the customer agrees to the repair. However, in cases where the repair is not performed, the fee remains non-refundable. Our technicians will provide a detailed quote, including all service charges and applicable taxes, prior to commencing any repair work.

Payment Terms and Methods

Additional Payment Terms

  • Any returned checks or failed payments will incur return charges of $50, in addition to any bank fees or penalties.
  • For unpaid invoices, interest will accrue at the annual rate of 18% or the maximum allowed by law, whichever is lower.
  • Failure to pay outstanding balances may result in collection efforts, including legal action. Customers will be responsible for all damage costs, attorney fees, and collection expenses.

Limited Warranty

We take pride in providing high-quality services and support for our customers. All repairs are covered by a limited warranty designed to give you peace of mind and protect your investment.

Warranty Coverage

The warranty period covers labor for 90 days and parts for 12 months. If an appliance exhibits identical symptoms during this period, we will inspect and address the issue at no additional charge. This coverage applies to all repairs performed using standard materials and adheres to manufacturer specifications for replacement parts.

Warranty Exclusions

Our warranty does not cover the following:

  • Normal wear and tear on components.
  • Issues arising from improper installation or failure to meet water drainage requirements or electrical supply standards.
  • Damage resulting from customer misuse, such as overloading appliances or ignoring safety protocols.
  • Repairs affected by component failure unrelated to the original issue.
  • Cosmetic parts, including panels, knobs, or trim.
  • Repairs on appliances used in commercial contexts that exceed standard residential use.

Disclaimer of Warranties

Our repair warranty is exclusive and replaces all other warranties, whether expressed or implied, including warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

Key West Appliance Repair limits its liability for damages including direct, incidental, or consequential damages, regardless of the cause. These limitations apply to claims of breach of warranty, negligence, or strict liability.

Examples of excluded claims include, but are not limited to:

  • Consequential damages such as spoiled food, lost revenue, or canceled events.
  • Incidental damages caused by unforeseen issues such as electrical surges or plumbing malfunctions.
  • Claims arising from risk of damage during repairs, including property damage to floors, counter tops, or cabinetry.

Our limitations of liability are intended to protect both parties and ensure fair resolution of issues.

Damage Waivers

Certain appliance repair services carry inherent risks, and our damage waiver policy addresses these scenarios. By engaging our services, you acknowledge and accept these risks.

Waiver of Damages When Moving Appliances

Moving appliances can cause unintended damage to floors, walls, cabinetry, or the appliance itself. Customers agree to release Key West Appliance Repair from liability for damages unless caused by identifiable carelessness by our technicians.

Waiver of Damages When Working with Water

Repairs involving water connections (e.g., water valves or water supply) may result in unintended leakage or flooding. While we take precautions to minimize risks, customers accept responsibility for any catastrophic damage caused by issues outside our control.

Waiver of Damages from Failed Cooling Equipment

Refrigeration units and freezers are complex appliances with numerous complex components that can fail unexpectedly. Key West Appliance Repair is not liable for spoilage, discomfort, or business losses resulting from repairs or unforeseen component failure.

Waiver of Damages from Lifting Glass Cooktops

Repairs involving glass cook or ceramic cook appliances may pose a risk of breakage due to their fragile construction and the strong adhesive used in assembly. Customers accept full responsibility for such risks before work begins.

Customer Responsibilities

Customers are responsible for ensuring that their appliances meet all water drainage requirements, electrical junction boxes are accessible, and the area surrounding the appliance is safe for repairs. Failure to prepare the appliance properly may result in delays or additional charges.

Entire Agreement

This Terms of Use document, along with any service contract and additional terms provided at the time of service, constitutes the complete agreement between Key West Appliance Repair and the customer. It supersedes any prior discussions or agreements, whether written or oral.

Governing Law and Dispute Resolution

The laws of Florida govern all agreements and transactions. Any disputes arising under these terms will be resolved in accordance with local and federal regulations. Binding arbitration may be used to resolve disputes efficiently.

Changes to Terms

Key West Appliance Repair reserves the right to modify these terms from time to time. Updated terms will be posted on our website, and continued use of our services indicates your acceptance of these changes.
